Welcome to Badola AI. These Terms of Service ("Terms") govern your access to and use of the Badola AI website, applications, and services (collectively, the "Service"). Please read these Terms carefully before using our Service.

1. Acceptance of Terms

By accessing or using Badola AI, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

2. Description of Service

Badola AI is an AI-powered fashion visualization platform that allows users to:

• Upload images of clothing items
• Select from a library of 40+ professional AI models
• Generate AI-powered visualizations of clothing on selected models
• Download and use generated images for personal or commercial purposes (depending on subscription plan)
• Manage a personal library of clothing items and generated images

3. Account Registration

To use certain features of the Service, you must register for an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. By registering, you represent that you meet this age requirement.

4. Subscription Plans and Tokens

4.1 Token System

Our Service operates on a token-based system. Each image generation consumes one (1) token. Tokens are included with your subscription plan or free trial.

4.2 Free Trial

New users receive 10 free tokens upon registration. Free trial tokens are valid for 30 days from the date of registration and do not roll over.

4.3 Paid Subscriptions

We offer the following subscription plans:

• Basic ($9/month): 50 tokens per month
• Pro ($29/month): 200 tokens per month, priority processing, commercial usage rights
• Business ($99/month): 1000 tokens per month, fastest processing, API access, dedicated support

4.4 Token Expiration

Unused tokens expire at the end of each billing period and do not roll over to the next month. We recommend using your tokens before your billing period ends.

4.5 Billing and Cancellation

Subscriptions are billed monthly in advance. You may cancel your subscription at any time. Upon cancellation, your subscription will remain active until the end of the current billing period, but will not renew. No refunds are provided for partial months or unused tokens.

4.6 Price Changes

We reserve the right to modify subscription prices. We will provide at least 30 days' notice before any price changes take effect for existing subscribers.

5. User Content

5.1 Ownership

You retain ownership of all images you upload to the Service ("User Content"). By uploading content, you grant Badola AI a non-exclusive, worldwide, royalty-free license to use, process, store, and display your content solely for the purpose of providing the Service to you.

5.2 Your Representations

By uploading content, you represent and warrant that:

• You own or have the necessary rights to the content you upload
• Your content does not infringe any third party's intellectual property rights
• Your content does not violate any applicable laws or regulations
• Your content does not contain nudity, explicit material, or inappropriate content

5.3 Generated Images

You own the AI-generated images created through the Service using your uploaded content. For Pro and Business subscribers, these images may be used for commercial purposes. Basic plan users are granted personal, non-commercial usage rights only.

6. AI-Generated Content Disclaimer

Our Service uses artificial intelligence to generate fashion visualizations. By using the Service, you acknowledge and agree that:

• AI-generated images may not be perfect or completely accurate representations
• Generated images are approximations and may differ from real photographs
• Colors, fit, and other details may vary from the original clothing item
• We do not guarantee that generated images will meet your specific requirements
• AI models used in generation are synthetic and do not represent real individuals

7. Prohibited Uses

You agree not to use the Service to:

• Upload content that infringes intellectual property rights of others
• Create or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Generate content depicting nudity, explicit sexual material, or violence
• Impersonate any person or entity or misrepresent your affiliation
• Attempt to gain unauthorized access to the Service or its systems
• Use automated systems, bots, or scripts to access the Service without permission
• Interfere with or disrupt the Service or servers connected to the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service for any illegal or unauthorized purpose
• Resell, redistribute, or sublicense access to the Service

8. Intellectual Property

The Service, including its original content, features, functionality, AI models, and branding, is owned by Badola AI and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Badola AI name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Badola AI. You may not use these marks without our prior written permission.

9. Third-Party Services

Our Service integrates with third-party services including:

• Supabase: Database and authentication services
• Replicate: AI image generation processing
• LemonSqueezy: Payment processing
• Google: OAuth authentication

Your use of these third-party services is subject to their respective terms and conditions.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BADOLA AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Badola AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may delete your account at any time through your account settings. Upon termination:

• Your right to use the Service will immediately cease
• Your account data will be marked for deletion
• Unused tokens will be forfeited with no refund
• Generated images associated with your account may be deleted

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
